Big Brolly Lottery - Terms & Conditions

DEFINED TERMS
In these terms and conditions:
Application means an application form for entry into the Big Brolly Lottery, which may be obtained from and should be returned to Friends of The Children's Centre;
Entrant means the holder of a Ticket;
Friends of The Children's Centre means Friends of The Children's Centre Ltd, a company registered in the Isle of Man with number 111721C, a registered charity in the Isle of Man with number 923 and registered with the Isle of Man Gambling Supervision Commission; and
Ticket means a ticket for the Big Brolly Lottery monthly draw.

THE BIG BROLLY LOTTERY
1. The Big Brolly Lottery is promoted on behalf of Friends of The Children's Centre.
2. Friends of The Children's Centre is a registered charity in the Isle of Man with number 923 and is registered with the Isle of Man Gambling Supervision Commission.
3. The Big Brolly Lottery is a 'society lottery' for the purposes of the Gaming, Betting and Lotteries Act 1988 (as amended).
4. These terms and Conditions are the rules of the Big Brolly Lottery. By completing an Application each applicant or Entrant agrees to be bound by these terms and conditions.
5. Friends of The Children's Centre reserves the right to disqualify any Entrant it believes, in its absolute discretion, has breached these terms and conditions in any way.

ENTERING THE BIG BROLLY LOTTERY
6. An application for entry into the Big Brolly Lottery must be by way of a completed Application and a completed direct debit form.
7. Friends of the Children's Centre reserves the right to reject any Application without giving a reason for such rejection.
8. No Application will be accepted unless the applicant is aged 18 or over.
9. Upon receipt and acceptance of an Application, the applicant (as detailed in the Application) shall become an Entrant and shall, subject to them paying the relevant Ticket price by direct debit each month and to clause 5, be granted a Ticket for each Big Brolly Lottery monthly draw until they withdraw as an Entrant. [Physical tickets will not be issued to Entrants.]
10. In the event that an Entrant's Ticket price is not paid by direct debit when due, the Entrant will not be entered into the Big Brolly Lottery monthly draw for the following month. Repeated failures to pay will result in the Entrant being disqualified from the Big Brolly Lottery.
11. A person's status and rights as an Entrant are not transferrable.

RULES OF PLAY
12. Each month, all Tickets for which Entrants have paid the relevant Ticket price will be entered into the Big Brolly Lottery monthly draw.
13. All Tickets for each Big Brolly Lottery monthly draw will be priced at £5.00.
14. Full payment for each Ticket will be taken by direct debit on the 28th of the month for entry into the following month's Big Brolly Lottery monthly draw. All funds must be cleared before a Ticket can be entered into the draw. Applications Direct debit forms will be processed as quickly as possible, but where they are received by Friends of the Children's Centre after the 18th of any month it is unlikely that they will be processed in time to include the applicant as an Entrant in that month's Big Brolly Lottery monthly draw.
14. The Big Brolly Lottery monthly draw will be made at The Children's Centre, 94 Woodbourne Road, Douglas, Isle of Man, IM2 3AS between 9am and 4pm on the 2nd Tuesday of each month or, if that day falls on a bank holiday, the next working day.
15. The maximum number of Tickets in each Big Brolly Lottery monthly draw shall not exceed 5,000. The minimum number of tickets in each Big Brolly Lottery monthly draw shall be 400. In the event that fewer than 400 Tickets are sold for any draw, the draw will be cancelled and all Tickets sold for it shall be carried forward to the following month's draw.
16. All Ticket sales are final and no refunds will be made at any time.

PRIZES
17. There will be one guaranteed prize of £1,000 each month, with no rollovers.
18. It is not necessary for an Entrant to be present at the draw to win a prize.
19. All Entrants acknowledge that payment of the Ticket price each month secures entry into the following month's Big Brolly Lottery monthly draw, but does not guarantee that they will win any prize.
20. Any cash prize awarded will be paid by cheque in the name of the winning Entrant only.
21. The numbers of all winning Tickets will be published by Friends of the Children's Centre via such media outlets as Friends of the Children's Centre determines, including, without limitation, Facebook, Twitter and websites.
22. Winning Entrants will be contacted by letter only.
23. It is the responsibility of the Entrant to provide Friends of The Children's Centre with their accurate and up-to-date contact details. Friends of The Children's Centre will not be liable for any failure or inability to contact any Entrant due to any errors, omissions or inaccuracies in the contact details provided by an Entrant.
24. If a prize or a winning Entrant's cheque remains unclaimed or uncashed, for any reason, for a period of six months from the date of the relevant Big Brolly Lottery monthly draw, the Entrant will automatically be deemed to have surrendered and waived his or her rights to such prize and the money representing the prize will be returned to Friends of The Children's Centre.

GENERAL
25. Friends of The Children's Centre shall not be liable to any Entrant, applicant for entry, or any other person for any loss or damage suffered or arising from:
a. the refusal of any Application;
b. any delay, failure or fault in the postal service or other delivery method used by Friends of The Children's Centre or any other person from time to time;
c. any delay, failure or fault in the software or other systems used for the administration of the Big Brolly Lottery;
d. any delay, failure or fault in the banking system used by Friends of The Children's Centre, the Entrant or any other person;
e. any refusal by Friends of The Children's Centre to accept registration of an individual as an Entrant or the withdrawal of an Entrant;
f. any failure to enter an Entrant or a Ticket into any Big Brolly Lottery monthly draw; or
g. any event beyond the reasonable control of Friends of The Children's Centre.
26. Any Entrant who has any complaint with reference to the Lottery should refer the same to the Chief Executive Officer for determination. Entrants should address a written complaint to: The Chief Executive, The Children's Centre, 94 Woodbourne Road, Douglas, Isle of Man, IM2 3AS. In the event a complaint cannot be resolved directly between Friends of The Children's Centre and the Entrant, complainants should contact the Gambling Supervision Commission by emailing gaming@gov.im 
27. The Big Brolly Lottery is operated under Isle of Man Law and all Entrants submit to the exclusive jurisdiction of the Isle of Man Courts.
28. Friends of The Children's Centre is committed to protecting Entrant's privacy. Data that is collected from an Entrant is used lawfully in accordance with the laws of the Isle of Man and is used solely for the purpose of processing lottery chance. If you wish to receive information regarding other Friends of The Children's Centre events via email, please opt in by indicating on your Application.
29. Friends of The Children's Centre reserves the right to amend these terms and conditions at any time. If Friends of The Children's Centre does this, it will publish the amended rules at www.thechildrenscentre.org.im.
30. The promoter of the Big Brolly Lottery is Jane Dellar, who is a member of Friends of The Children's Centre authorised by its governing body to act as such.
31. The Big Brolly Lottery is a form of gambling. Please play responsibly. Friends of the Children's Centre is dedicated to providing Entrants with a responsible gaming environment and to help prevent compulsive usage of or underage access to the Big Brolly Lottery. Players have the opportunity to exclude themselves from entry by providing the Lottery Operator with their name, address & email address in order that the Lottery Operator can decline an application from a player who wishes to utilise such a control.
